This Section is an express written media and promotional release incorporated into the Agreement. Licensor authorizes DCR, during the Term and subject to the rights Licensor owns, controls, or is authorized to grant, to photograph, film, record, livestream, edit, caption, excerpt, reproduce, publish, display, distribute, and otherwise use Licensor's name, artist/stage name, portrait, picture, image, voice, likeness, interview statements, performances, DCR appearances, behind-the-scenes footage, and other DCR-created media featuring Licensor for DCR editorial, station, artist-discovery, and promotional purposes.
Licensor further grants DCR a non-exclusive, royalty-free, fully paid-up license, to the extent Licensor has authority over both the applicable sound-recording and musical-composition rights, to synchronize and reproduce reasonable excerpts of the Tracks in DCR-created audiovisual content, including interviews, artist spotlights, release announcements, countdowns, news or editorial coverage about the artist, station promos, teasers, short-form clips, reels, shorts, livestream promos, event promotion, and similar content. DCR will not intentionally distribute the complete Track as a standalone downloadable recording or full-length on-demand music stream unless separately authorized.
Authorized DCR content may be published on DCR-controlled websites, applications, email communications, streaming/player surfaces, and social or video accounts, including TikTok, Instagram, Facebook, YouTube, X, Threads, and comparable future services. Uses may be organic, platform-monetized, sponsored by DCR, or boosted/used as paid DCR advertising to promote DCR Radio, the artist, the Track, a DCR program, interview, event, contest, or station activity. This permission does not authorize DCR to falsely state or imply that Licensor endorses an unrelated third-party product, service, political candidate, or cause without separate consent.
DCR may edit content for length, format, captions, titles, thumbnails, aspect ratio, clean-language requirements, accessibility, platform specifications, and promotional pacing, provided DCR does not intentionally create a materially false depiction of Licensor. DCR may authorize social-media, hosting, advertising, content-delivery, and rights-management providers to technically host, reproduce, encode, transcode, display, distribute, and process the authorized content as reasonably necessary to exercise DCR's rights under this Section.
Unless separately agreed in writing, DCR owes no additional appearance fee, synchronization fee, master-use fee, promotional fee, or share of DCR's platform, advertising, sponsorship, or promotional revenue solely because an authorized DCR post or video is monetized, sponsored by DCR, or boosted, to the extent Licensor validly granted the applicable rights.
If a Track is enrolled in YouTube Content ID or another automated rights-management system, Licensor shall disclose that fact and the known administrator. Licensor agrees to reasonably cooperate in releasing or preventing automated claims against authorized DCR uses, including allowlisting a DCR channel when the applicable administrator/platform offers that capability. Platform claim systems may still restrict or delay content even when DCR has contractual permission, and DCR does not guarantee that any platform will accept, monetize, or keep content available.
On termination, DCR will stop creating new promotional uses of a terminated Track and will make commercially reasonable efforts to stop active paid boosts or campaigns involving that Track within thirty (30) days. Previously published interviews, posts, clips, historical station content, comments, shares, embeds, platform copies, analytics, archives, and records documenting prior authorized use may remain available unless removal is required by law, a valid rights claim, or a separate written agreement.
