DJ / Program Host Agreement

This DCR Radio DJ / Program Host Agreement (“Agreement”) is between DCR Entertainment LLC, operating publicly as DCR Radio (“DCR” or “Station”), and the individual signing as DJ / Program Host (“DJ”). The purpose is to establish rules for scheduled live or prerecorded programming, platform access, promotion, and music-rights compliance.

DCR may approve DJ for a one-time, recurring, substitute, or guest program. DCR controls the final schedule, show duration, format, programming standards, and whether a show remains active. No particular time slot, frequency, audience level, or length of participation is guaranteed.

If approved, DCR may invite DJ to the Station’s Radio.co account using a DJ, Guest DJ, or other appropriate role available to DCR. DJ shall use only DJ’s own credentials, shall not share login or broadcast credentials, and shall access the Station only during approved programming windows. DCR may revoke platform access at any time.

Unless DCR gives prior written approval after obtaining any additional licensing it determines is necessary, DJ may broadcast only: (a) Tracks already approved and directly licensed to DCR; (b) DJ-owned original music for which DJ owns or controls all rights necessary for the broadcast; (c) royalty-free or production-library music where the applicable license expressly authorizes internet radio, webcasting, public performance/digital transmission, and the intended commercial or promotional use, if applicable; and (d) original talk, interviews, station imaging, sound effects, and other content DCR has approved for use.

For any DJ-owned music used in a DCR radio show, DJ grants DCR a non-exclusive, royalty-free, fully paid-up license, to the extent DJ owns, controls, or is authorized to license the applicable rights, to digitally transmit, publicly perform, stream, host, encode, schedule, technically process, and broadcast that music as part of DCR's live radio programming. Ownership remains with DJ and other applicable owners. DJ's general media clearance or a 'Yes' answer concerning DJ-owned music social authority does not, by itself, clear a specific music Track for TikTok, Instagram, Facebook, YouTube, paid advertising, on-demand replay, or other social/video use. Before DCR uses DJ-owned music in social/video content, the exact Track must be separately approved under DCR's artist/New Song social-video clearance workflow or another written track-specific license approved by DCR.

“Royalty-free” does not mean that every use is automatically permitted. DJ is responsible for reviewing the actual license. Upon request, DJ must provide DCR with a copy or accessible link showing the source, license terms, permitted uses, and any attribution or other conditions. DCR may reject any track if the license is unclear, limited to personal use, limited to background use, excludes broadcasting/webcasting, or may create additional fees or obligations for DCR.

DJ shall not broadcast mainstream or other third-party copyrighted music, consumer-streaming audio, bootlegs, leaked tracks, pirated files, uncleared remixes, mashups, samples, covers, mixtapes, or other protected material unless DCR has specifically approved that content in writing and the necessary rights or licenses are in place. Technical ability to capture or stream audio from an app or website does not constitute legal permission to rebroadcast it.

DJ is responsible for the content DJ introduces into the live or prerecorded feed. DJ shall not intentionally broadcast unlawful material, threats, defamatory statements, unauthorized private information, deceptive advertising, unapproved copyrighted content, or content that violates DCR programming standards. DCR may interrupt, mute, end, edit, refuse, or remove programming when reasonably necessary to protect the Station, listeners, rights holders, sponsors, platform access, or legal compliance.

This Section is an express written media release. DJ authorizes DCR during the Agreement term to photograph, film, record, livestream, edit, caption, excerpt, reproduce, publish, display, and distribute DJ's approved air name, legal name if approved for public use, show title, biography, logo, social handles, approved photographs, portrait, picture, image, voice, likeness, interviews, DCR appearances, original spoken/host segments, and behind-the-scenes DCR footage for DCR editorial, scheduling, station, social-media, advertising, and promotional purposes.

Authorized DCR media may be organic, platform-monetized, sponsored by DCR, or boosted/used as paid DCR advertising for DCR Radio, DJ's DCR show, an interview, artist feature, DCR event, contest, or station activity. This does not authorize DCR to falsely imply DJ endorses an unrelated third-party product, service, political candidate, or cause without separate consent. Unless separately agreed, no additional appearance fee or share of DCR's platform or promotional revenue is owed solely because an authorized DCR post is monetized or boosted.

DJ may promote upcoming DCR shows and approved guests. Any paid sponsor, advertisement, product placement, contest, giveaway, political advertising, or commercial endorsement within a DCR program requires prior DCR approval. DJ may not sell DCR airtime or represent that DJ can bind DCR to a sponsor, advertiser, artist, or third party.

DJ must tell DCR about planned interview guests when reasonably practicable. A guest who is not already covered by a DCR artist, DJ, or other written media release may be required to sign a DCR guest/interview release before DCR publishes promotional or social-media footage featuring that guest. DJ may not promise that DCR owns or may commercially use a guest's name, image, voice, likeness, music, photography, or other content without the required permission.

DCR may record live or prerecorded programming for monitoring, compliance, quality control, internal review, editing, promotion, and authorized social/video use. DCR may publish DJ's original spoken segments, interviews, show promos, behind-the-scenes footage, station imaging, and other DCR-cleared material as short-form or long-form DCR content. A DCR radio broadcast, DJ set, or mixed show is not automatically cleared for social-media replay or on-demand publication. DCR will not intentionally publish a music-containing show on demand, as a podcast, as an archived mix, or as a social video containing music unless DCR reasonably determines every included music use is separately cleared for that additional use. DCR may mute, replace, edit around, or omit music when preparing a social/video clip. A DJ's claim that DJ owns original music is not sufficient social clearance for a specific Track; the Track must be separately cleared through DCR's track-specific workflow or another written track-specific license. DJ must disclose known Content ID or automated-rights administration and reasonably cooperate with claim release or allowlisting for authorized DCR uses when available.

DJ shall make reasonable efforts to maintain a stable internet connection, suitable audio levels, working microphone/mixer or approved broadcast setup, and professional transitions. DJ should be ready before the assigned show and follow DCR connection instructions. If DJ cannot appear, DJ should notify DCR as soon as reasonably possible so DCR can use backup programming or adjust the schedule.

No compensation is owed under this Agreement unless DCR and DJ separately agree to compensation in writing for a particular period, program, sponsor arrangement, or service. This Agreement does not by itself promise employment, wages, a partnership, ownership interest, agency authority, or a permanent hosting position. The parties’ legal relationship will be determined by applicable law and the actual arrangement.

DCR does not guarantee a show, audience size, listener count, promotion level, interview opportunity, sponsor, prize, continued Radio.co access, continued time slot, or any specific business or career result.

DCR may immediately suspend DJ’s show or access when DCR reasonably believes there is a copyright/licensing issue, platform violation, security issue, missed-show pattern, conduct problem, legal demand, rights-holder complaint, or other material risk to DCR. DJ shall cooperate with reasonable rights and compliance requests.

DJ represents that information supplied to DCR is accurate; DJ has the rights and authority claimed for content DJ introduces into the broadcast or provides for social/video use; and photographs, videos, graphics, music, news footage, clips, guest materials, or other media supplied to DCR are owned or properly authorized for the intended DCR use.

DJ agrees to indemnify and hold harmless DCR Entertainment LLC, DCR Radio, and their officers, members, employees, contractors, hosts, agents, and service providers from third-party claims, liabilities, losses, and reasonable legal costs arising from DJ's material breach, misrepresentation, unauthorized copyrighted content, unauthorized name/image/voice/likeness use, unapproved social-media material, or lack of authority to grant rights.

DCR uses Radio.co and may use social-media, video, hosting, advertising, content-delivery, rights-management, editing, analytics, and other third-party technology to host, schedule, transmit, record, encode, transcode, publish, display, distribute, analyze, advertise, or deliver authorized programming and media. DJ authorizes DCR to permit the technical processing reasonably necessary for DCR to exercise the rights granted in this Agreement. Platform features, eligibility, music libraries, copyright systems, user-seat limits, plans, and policies may change, and DCR may modify workflow as reasonably necessary to remain compatible and compliant.

This Agreement begins when electronically accepted by DJ and remains in effect until ended by either party. Either party may end participation by written notice; DCR may remove platform access immediately. DCR will stop creating new promotional uses of DJ after termination within a commercially reasonable period and will make reasonable efforts to stop active DCR-paid campaigns featuring DJ within thirty (30) days. Previously published posts, interviews, clips, program archives that were lawfully cleared, shares, embeds, analytics, screenshots, and historical station records may remain unless removal is required by law, a valid rights claim, or a separate written agreement. Rights reasonably necessary to document prior lawful broadcasts and media uses, preserve legal/compliance records, or retain historical station records survive termination. This Agreement is governed by the laws of the Commonwealth of Virginia. Venue for disputes shall lie in an appropriate court serving Lynchburg, Virginia, subject to applicable law.

Electronic signatures and electronic acceptance are intended to be enforceable to the fullest extent permitted by law. This Agreement and any written show-specific addendum or compensation agreement constitute the parties’ agreement regarding DJ participation. If a provision is unenforceable, the remaining provisions remain in effect.
